Tottie Affiliate Program Policy

Thank you for being part of the Tottie Affiliate Program! We are thrilled to collaborate with passionate creators, parents, and brand advocates who love what we do. To ensure fairness, protect the Tottie brand, and help everyone get the most out of the program, please read and adhere to the following policy guidelines.

This Affiliate Program Policy outlines the terms and conditions for participating in the Tottie Australia Affiliate Program (the "Program"). By applying to and participating in the Program, you ("Affiliate") agree to be bound by the terms and conditions set forth below. Tottie Australia ("Tottie", "we", "us", "our") reserves the right to modify this Policy at any time, and it is your responsibility to review this Policy periodically for any updates. Continued participation in the Program after any such modifications constitutes your acceptance of the revised Policy.

1. Program Overview

The Tottie Affiliate Program allows individuals and businesses to earn commissions by referring customers to our website, www.tottie.com.au, through unique affiliate links and codes.

2. Enrollment in the Program

To become an Affiliate, you must submit an application through our designated affiliate platform.
We reserve the right to approve or reject ANY Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.
Upon acceptance, you will be provided with unique affiliate links and may be provided with affiliate codes to track your referrals.

3. Affiliate Links and Codes

Affiliate links are automatically generated, and you may also be able to generate affiliate links for specific products or collections.
If a customer clicks on another affiliate's referral link and subsequently clicks on yours, the commission will be attributed to the link that was clicked last prior to the purchase.

4. Earning Commissions

Commissions are earned on eligible sales that are directly attributed to your unique affiliate link or code.
A "successful referral" occurs when a customer clicks on your affiliate link or uses your unique affiliate code at checkout on tottie.com.au and completes a valid purchase.
The commission rate will be communicated to you upon acceptance into the Program.
Commissions are only paid on the net sales amount (excluding shipping fees, taxes, and discounts).

5. Affiliate Responsibilities and Guidelines

Promotion: You are encouraged to promote Tottie through authentic, organic content on the following platforms: Instagram, Facebook, TikTok, YouTube, Blogs
Brand Alignment: All content created and shared by you must align with Tottie’s branding: empowering, warm & relatable, playful & stylish, on-trend, optimistic and supportive of the parenting journey.
Ethical Promotion: You must not make false claims, misrepresent product features, or publish content that may harm the reputation of Tottie.
Compliance with Laws: You are responsible for ensuring that all your promotional activities comply with all applicable laws and regulations, including those related to advertising and disclosure.

6. Prohibited Activities

Paid Search Restrictions: Affiliates are strictly prohibited from bidding on Tottie branded keywords, including misspellings and close variants, in any paid search campaigns (e.g., Google Ads, Bing Ads). This prohibition extends to any search keyword containing the brand name 'Tottie', such as 'Tottie baby bag', 'Tottie bag', 'Tottie nappy bag', and any other variation including 'Tottie'.

Affiliates are required to implement a comprehensive negative keyword list that includes all Tottie branded terms. This is to prevent affiliate ads from competing with official Tottie paid search campaigns and retargeting Tottie's existing customers who may already be aware of and searching for the brand directly.

Any commissions resulting from such prohibited activity will be invalidated, and may lead to removal from the affiliate program.

Discount Platform Restrictions: Your affiliate codes must not be listed on public discount platforms such as Honey, RetailMeNot, OzBargain, or any other publicly accessible coupon or deal-sharing websites.
Cookie Stuffing: You must not employ any methods of "cookie stuffing" or any other techniques that result in the tracking of users without their genuine interaction with your affiliate link or code.
Spam and Unsolicited Communications: You must not engage in spamming, mass unsolicited emails, or any other form of intrusive or unethical advertising.
Website Content: Your website or social media channels must not contain content that is unlawful, harmful, defamatory, obscene, harassing, or discriminatory.
Direct Sales: You are not authorised to act as a reseller or distributor of Tottie products. Your role is solely to refer potential customers to our website.
Self-Referrals: Self-referrals are not permitted. Any attempts to game the system will result in commission reversal and potential removal from the Program.
Competitive Campaigns: Affiliates should not run campaigns that directly compete with Tottie’s official campaigns or use similar creative that could cause brand confusion.

7. Brand Approval & Content Review

Tottie may occasionally request to review your content or require modifications to ensure brand consistency and adherence to our guidelines.
Please ensure any promotions or campaigns using the Tottie name/logo are pre-approved if outside of standard affiliate use.

8. Commission Payments

Commission payments will be processed on a monthly basis, provided that the earned commission balance meets the minimum payout threshold of $100 AUD
Payments will be made via PayPal or Bank Transfer. You are responsible for ensuring your payment details are accurate and up-to-date within the affiliate platform.
We reserve the right to withhold or adjust commission payments in cases of suspected fraud, policy violations, or order cancellations/returns.

9. Tracking and Reporting

You will be provided with access to a reporting dashboard where you can track your clicks, referrals, and earnings.
The tracking and reporting provided by our affiliate platform will serve as the official record of your performance and earnings.

10. Termination

We reserve the right to terminate your participation in the Program at any time, with or without cause.
Reasons for termination may include, but are not limited to, violation of this Policy, prolonged inactivity, or any conduct that we deem harmful to our brand.
Upon termination, all outstanding commissions earned up to the date of termination will be paid, provided they meet the minimum payout threshold and are not subject to withholding due to policy violations.

12. Intellectual Property

We grant you a non-exclusive, non-transferable, revocable license to use our trademarks, logos, and marketing materials solely for the purpose of promoting Tottie in accordance with this Policy.
You acknowledge that all intellectual property rights in and to the Tottie brand and materials remain our sole property.
You must not alter or modify our trademarks, logos, or marketing materials in any way without our prior written consent.

12. Relationship of Parties

You are an independent contractor, and nothing in this Policy shall be construed to create a partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Tottie.
You are solely responsible for your own business operations, expenses, and taxes.

13. Limitation of Liability

To the maximum extent permitted by law, Tottie shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Program, even if we have been advised of the possibility of such damages.

14. Governing Law

This Affiliate Program Policy shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
