Skin At Peace Affiliate Program Terms & Conditions

Company: Skin At Peace, LLC (“Skin At Peace,” “we,” “us,” or “our”)
Affiliate: The individual or entity (“you” or “Affiliate”) applying to participate in the Skin At Peace Affiliate Program (“Program”).

1. Overview

By enrolling in the Skin At Peace Affiliate Program, you agree to the terms, conditions, and policies set forth below. These Terms govern your participation in the Program and establish a legally binding relationship between you and Skin At Peace.

2. Affiliate Relationship

You acknowledge and agree that your participation in the Program does not create an employer–employee relationship, partnership, joint venture, franchise, or agency relationship. You act as an independent contractor in all respects.

3. “At Will” Agreement

Your participation in the Skin At Peace Affiliate Program is “at will”, meaning that either party may terminate or modify this relationship at any time, with or without cause, and without prior notice. Skin At Peace reserves the right to:

Suspend or terminate your affiliate account at any time;
Withhold or revoke commissions for any violation of these Terms;
Modify the structure, rates, or conditions of the Program at any time.

Continued participation in the Program following changes constitutes your acceptance of the updated Terms.

4. Eligibility Requirements

To qualify for and remain in the Program, you must:

Be at least 18 years of age;
Operate a legitimate business or personal platform aligned with Skin At Peace’s brand values;
Refrain from engaging in false, misleading, or unethical marketing practices;
Comply with all applicable laws and advertising guidelines (including FTC disclosure requirements for affiliate relationships).

5. Promotional Guidelines

You agree to represent Skin At Peace with integrity, honesty, and professionalism. Specifically, you must:

Clearly disclose your affiliate relationship in all communications (“As a Skin At Peace affiliate, I may earn commissions…”);
Only use approved brand assets (logos, photos, videos, and copy provided by Skin At Peace);
Not engage in paid search bidding on “Skin At Peace” or similar branded keywords;
Not alter or modify our brand assets without written approval;
Not make medical claims or statements not approved by Skin At Peace.

6. Commissions and Payments

Affiliates earn commissions based on verified sales attributed through their unique tracking links.

Commission Rate: 40% of net sales (excluding taxes, shipping, and returns).
Payments are issued via [Shopify Payments / PayPal / etc.] according to the platform schedule.
Orders canceled or refunded by customers are not commissionable.
Fraudulent, self-referred, or bulk test orders are prohibited and will void commissions.

7. Intellectual Property

All trademarks, content, imagery, and materials provided by Skin At Peace remain the sole property of Skin At Peace, LLC. You are granted a limited, non-exclusive, revocable license to use approved assets solely for participation in this Program.

8. Confidentiality

You agree to maintain the confidentiality of all non-public information obtained through participation in the Program, including pricing structures, marketing strategies, and partner data.

9. Termination

Skin At Peace may terminate your participation immediately and without prior notice if you:

Breach any provision of this Agreement;
Engage in conduct detrimental to the brand or its reputation;
Misrepresent the brand or violate applicable laws.

Upon termination, you must immediately discontinue all use of Skin At Peace intellectual property, promotional materials, and links. Any unpaid commissions may be forfeited if termination results from a breach of this Agreement.

10. Limitation of Liability

Skin At Peace shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of this Program. Our total aggregate liability under these Terms shall not exceed the total commissions paid to you during the preceding 3-month period.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.

12. Entire Agreement

This document constitutes the entire understanding between you and Skin At Peace with respect to the Affiliate Program and supersedes all prior communications or agreements.

13. Acknowledgment

By applying to or participating in the Skin At Peace Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
